Current Practice of Antitrust Authorities and Courts Regarding Inclusion in the Register of Unscrupulous Suppliers

Abstract
Inclusion of information about economic entities, their executives and founders in the register of unscrupulous suppliers is a one of the main tools for countering violations in the conclusion and execution of public contracts and agreements under Federal Laws No. 44 FZ and 223 FZ. At the same time, this public sanction excludes (limits) suppliers’ right to participate in relevant procurement procedures for two years. Consequently, disputes regarding inclusion in the register are always significant, and the emerging practice must be taken into account by suppliers, customers and antitrust authorities alike. This article examines such practice with respect to several of the many current issues that have arisen in specific factual circumstances.
